KORONADAL CITY, South Cotabato, July 18 (PIA)– In accordance with its continuing campaign against fraud, PhilHealth XII recently filed cases against three employers for failure to remit employees’ contributions to the health insurance corporation.
Said move was an offshoot to the pronouncements of former PhilHealth XII Legal Office chief, Atty. Jusen Lubaton.
“We have been trying to be lenient with them for the past ten years. We have been trying to negotiate just for them to settle their obligation and we are already running short of patience. There will be more as reported by the Collection Section. We will be filing the corresponding cases based on their evaluation. There are 40 more employers who will be charged and certainly, these will wake them up,” Lubaton said in a conference in June.
Cases were filed against three employers located in Koronadal City, General Santos City and Province of Sarangani for non-remittance of premiums involving a total count of 119.
Aside from the civil liability consisting of the actual premiums not remitted, the employers are also liable for interests and surcharges and cost suit.
The criminal liability consists of fines amounting to P5,000 to P10,000 per affected employee. One month missed remittance is one count of the offense.
As an example, the complaint filed against an employer in General Santos could result to a sentence with a fine of Php 4.6 M and the owner or manager is solidarily liable with the employer.
The employers in Gensan failed to remit more than P100,000 while the one in Koronadal did not pay about P80,000 premiums.
